Acceptable Usage Policy:

We have implemented the following "acceptable use policy" for the benefit of all our clients. The purpose of these rules is to protect us from unwanted activities so that we may concentrate on providing our clients with the best possible and most reliable hosting services and features. If you need any clarification after reading through the following "acceptable use policy", please feel free to e-mail us at support@jsp-servlet.net so we can clear up any questions you have.

Client is expected to use the Internet responsibly and to be courteous and respectful of the rights of other Internet users. When considering what is and is not acceptable use, common sense should be the best guide. Following these simple policies should ensure that clients do not encounter any problems with their service.

1) Copyrighted Material

Clients are responsible for ensuring that all information in their account is their own original work. Clients are also not allowed to distribute any freeware software programs unless those programs are their own work. Art and music, including MP3's (a popular file format for encoding music) are examples of copyrighted materials. Any MP3s you have on your website must not be in violation of any copyrights. No copyrighted music, in any format, can be placed in client's account. Clients agree to indemnify JSN of all possible litigation involving trademark or copyrighted materials, should it arise.

2) E-mail/Spam Policy

Clients must not send unsolicited e-mail, also known as "spam," through our mail servers. This policy also includes the promotion of a website hosted with us via unsolicited email. Whether the email was sent through our servers or another mail servers is not relevant. The definition of "spamming" is the sending of unsolicited e-mail, regardless of size or volume, to persons the sender does not know or have prior consent to send the message to. Spamming also includes sending unsolicited advertisements to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user. It is strictly forbidden to use fictitious e-mail addresses xxx@jsp-servlet.net or any domain name hosted with JSN. Clients are also in violation if they send unsolicited e-mail from a domain name not affiliated or hosted with JSN but the message mentions a website hosted with JSN.

JSN allows clients operate mailing lists and to send mailings to subscribers of those lists. However, such mailings must have clear instructions to recipients to inform them on how to remove themselves from the list. Additionally, any such request must be honored immediately. Client may not send mailings to lists provided by any outside agency or individual. Client also may not provide mailing list services to others. JSN requests that mailing lists be sent during non-peak hours due to the nature of a shared-server environment. Non-peak hours are between the hours of 1:00 am and 5:00 am, EST. If a list causes a problem with the e-mail services of other clients, JSN reserves the right to terminate a client's mailing program, whether provided by JSN or not. Termination can occur immediately and without notification to client. Additionally, JSN reserves the right to prevent a client from utilizing any mail-sending program that causes problems to the mail services of other clients.

Providing spamware, spam related programs or e-mail lists available for download on your site is strictly prohibited.

Trolling, which is the posting of provocative messages to encourage a large amount of responses, is not allowed. The following are also strictly forbidden: sending multiple messages without significant new content to the same user, subscribing someone to any mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups and attempting, without authorization, to enter into a secured computer system. JSN reserves the right to determine what constitutes abuse of this policy. At the discretion of JSN, Clients whose accounts are found to be in violation of this policy may have their account(s) terminated without notice.

3) Restricted Content

Websites which contain any type of adult graphic content, such as child pornography, banners advertising adult websites, and distribution of adult website passwords are not allowed. At the discretion of JSN, clients whose accounts are found to be in violation of this policy may have their account(s) terminated without notice. Consequently, the following are also not welcome at JSN: websites which promote activities in violation of federal, state, or local laws, sites in violation of U.S. export restrictions, "warez" sites (freely distributing copyright programs), or sites which promote hacking or cracking programs. At the discretion of JSN, clients whose accounts are found to be in violation of this policy may have their account(s) terminated without notice. Additionally, JSN reserves the right to contact the Software Piracy Association ("SPA") and release any information in connection with illegal activities relating to software piracy on any Client's account.

4) Excessive usage

IRC Bots, or any other automaton programs specifically in conjunction with IRC are not allowed as these programs tie up system resources and are not related to website maintenance. Clients are not allowed to have any IRC-related programs within their account. If a Client is found to be in violation of this policy, JSN will remove the IRC-related program from the account and the Client will be notified immediately. Should a second violation occur, at the discretion of JSN, the account(s) may be terminated without notice. The use of the Gossamer Links program is forbidden due to the consumption of system resources and overloading of the e-mail server. Client is fully responsible for all programs, including CGI scripts, executed under their account. Programs that consume an excessive amount of CPU run time or Random Access Memory (RAM) are not permitted. Excessive use can have an adverse effect on the performance of the web server. Each user may get 5MB of RAM, the "right" to use 10% of the processor for 3 seconds maximum every minute. Client is fully responsible for all programs executed under his/her account, regardless of who authored the program. CGI or html chat scripts or pages are strictly prohibited. JSN reserves sole discretion over what constitutes excessive usage. Programs that are provided by JSN as an installable feature are also not exempt from this policy. Sites that are primarily used for file distribution or as mirror sites are prohibited.

5) Reselling policy

Clients are not allowed to resell extra FTP accounts, Email and Sub domains.

Any violation of this policy could subject your account to immediate termination. If this happens, your account will not be reinstated under any circumstance.

JSN reserves the right to, at any time, revise the Acceptable Uses Policy. Clients will be given advanced notice. The renewal of a virtual server with JSN constitutes acceptance to any and all modifications to the Terms of Services.
